These Terms & Conditions ("Terms") govern your access to and use of the Powerland website, products, and services, including the purchase and pre-order of Powerland electric ATVs. By accessing our website or placing a pre-order or purchase, you agree to be legally bound by these Terms. If you do not agree, please do not use our website or purchase our products.

1. Acceptance of Terms

By using the Powerland website, creating an account, placing a pre-order, or purchasing any product, you acknowledge that you have read, understood, and agree to these Terms & Conditions as well as our Privacy Policy, Warranty Policy, and Return & Refund Policy.

2. Eligibility

To purchase products from Powerland, you must:

• Be at least 18 years of age or the legal age of majority in your jurisdiction.
• Have the legal capacity to enter into a binding contract.
• Provide accurate and complete information during checkout.

Powerland reserves the right to refuse or cancel orders that do not meet these requirements.

3. Product Information

We strive to ensure all product information is accurate. However:

• Colors may vary depending on screen settings.
• Specifications, features, dimensions, and accessories may change without prior notice.
• Product information may contain typographical or technical errors.

Powerland reserves the right to correct any errors without liability.

4. Pre-Order Terms

What is a Pre-Order?

A pre-order allows customers to reserve a future production vehicle before it becomes available for delivery.

Deposit

A deposit may be required to reserve your vehicle. The applicable deposit amount will be shown during checkout.

Remaining Balance

The remaining balance must be paid before shipment unless otherwise agreed in writing.

Production Schedule

Production begins according to manufacturing schedules and available capacity.

Estimated Delivery

Estimated delivery dates are provided for convenience only and are not guaranteed. Manufacturing delays, component shortages, shipping disruptions, customs clearance, weather, government actions, force majeure events, or other circumstances beyond our control may affect delivery.

Production Delays

Powerland reserves the right to delay production or shipment when reasonably necessary.

Company Cancellation

Powerland may cancel a pre-order due to:

• Product discontinuation
• Regulatory restrictions
• Manufacturing limitations
• Pricing errors
• Suspected fraud
• Payment issues
• Circumstances beyond our reasonable control

If Powerland cancels a pre-order, any refundable amounts will be processed in accordance with our Return & Refund Policy.

Customer Cancellation

Customer cancellation requests are governed by the Return & Refund Policy. Deposits may be non-refundable depending on production status and applicable law.

5. Pricing & Payment

• All prices are displayed in United States Dollars (USD) unless otherwise stated.
• Taxes, import duties, customs fees, registration fees, and shipping charges are not included unless expressly specified.
• Accepted payment methods will be displayed during checkout.
• Prices may change before full payment is received.
• Orders are subject to payment authorization and verification.
• Powerland reserves the right to cancel orders resulting from pricing errors.

6. Shipping & Delivery

• Powerland ships to selected regions where our products are available.
• Delivery times are estimates only and may vary.
• Ownership and risk of loss transfer to the customer once the vehicle has been delivered to the shipping carrier or delivered to the customer, as applicable under the shipping terms provided with the order.
• Customers should inspect the shipment immediately upon delivery and report any visible shipping damage promptly.
• Powerland is not responsible for delays caused by carriers, customs authorities, weather conditions, labor disputes, government actions, or other events beyond our reasonable control.

7. DIY Assembly

Crate Delivery & Final Assembly

• Your Powerland Tachyon arrives securely packaged with major components pre-assembled.
• The customer is responsible for completing the final assembly by following the Owner's Manual and assembly instructions provided with the vehicle.
• Improper assembly may affect vehicle safety, reduce performance, cause component damage, or void portions of the warranty where damage results from incorrect assembly.
• If assistance is required, Powerland provides remote assembly guidance through our technical support team.

8. Maintenance & Service

Maintenance & Technical Support

Powerland electric ATVs are engineered with a simplified electric drivetrain, requiring significantly less routine maintenance than traditional gasoline-powered ATVs. Without engine oil, spark plugs, fuel filters, carburetors, or exhaust systems, ownership is simpler and more cost-effective.

Routine maintenance includes:

• Tire inspection and pressure checks
• Brake system inspection
• Suspension inspection
• Electrical connection inspection
• Proper battery charging and care
• Gearbox oil inspection and replacement as specified
• Greasing all recommended service points
• General vehicle inspection before and after use

Owners are responsible for following the maintenance schedules and procedures outlined in the Owner's Manual to ensure safe operation, optimal performance, and long-term reliability.

Remote Diagnostics & Technical Support

Powerland's direct-to-consumer ownership model is backed by a dedicated technical support team ready to assist whenever needed. If you experience a technical issue, our engineers can provide remote diagnostics and troubleshooting. In certain cases, you may be asked to connect a laptop to the vehicle's diagnostic system, allowing our technical team to review system data, diagnose fault codes, and guide you through the recommended troubleshooting or repair process.

Our technical support includes:

• Remote vehicle diagnostics
• Software and controller support
• Fault code troubleshooting
• DIY assembly guidance
• Maintenance assistance
• Spare parts identification and replacement guidance

No dealership service is required. By connecting you directly with our engineering team, we provide faster, more efficient support throughout your ownership experience.

Spare Parts Support

Powerland maintains a comprehensive inventory of genuine spare parts within the United States to support our customers and minimize vehicle downtime. If a replacement component is required, our team will quickly identify the correct part and arrange shipment as soon as possible.

9. Warranty

• Powerland vehicles are covered by a Limited Warranty.
• The Warranty Policy explains covered components, warranty periods, warranty exclusions, customer responsibilities, claim procedures, and limitations of coverage.

10. Returns & Refunds

Returns and refunds are governed by our Return & Refund Policy.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Powerland shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of profits, loss of use, business interruption, property damage, or other economic losses arising from the use or inability to use our products or website.

Powerland's total liability shall not exceed the amount paid by the customer for the applicable product.

12. Assumption of Risk

• Operating an all-terrain vehicle involves inherent risks, including the risk of serious injury, death, and property damage.
• By purchasing or operating a Powerland ATV, you acknowledge and voluntarily assume these risks.
• Users are responsible for operating the vehicle safely, wearing appropriate protective equipment, following all applicable laws and regulations, and riding only within their skill level.

13. User Responsibilities

Customers agree to:

• Comply with all local, state, and federal laws.
• Read and follow the Owner's Manual.
• Perform routine maintenance.
• Operate the ATV responsibly.
• Avoid misuse, racing, reckless riding, overloading, or unauthorized modifications.

14. Intellectual Property

All intellectual property displayed on the Powerland website, including but not limited to logos, trademarks, product names, vehicle photographs, videos, manuals, graphics, and website content, is owned by Powerland or its licensors and is protected under applicable intellectual property laws.

No content may be copied, reproduced, modified, distributed, or used without prior written permission.

15. Website Use

Users may not:

• Attempt unauthorized access
• Hack or interfere with website operations
• Upload viruses or malicious software
• Reverse engineer website software
• Scrape website content
• Use automated bots without authorization
• Misuse website services in any unlawful manner

Powerland reserves the right to suspend access for violations.

16. Third-Party Services

Powerland may use third-party service providers for payment processing, shipping and logistics, customer support, and email communications.

Powerland is not responsible for the policies or actions of independent third-party providers.

19. Dispute Resolution

• Before initiating legal proceedings, both parties agree to attempt to resolve disputes through good-faith informal negotiations.
• If a dispute cannot be resolved informally, it shall be resolved by binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.
• Nothing in this section limits either party's right to seek temporary injunctive relief where appropriate.

20. Changes to These Terms

• Powerland reserves the right to update or modify these Terms & Conditions at any time.
• Changes become effective immediately upon publication on the website unless otherwise stated.
• Continued use of the website after changes constitutes acceptance of the revised Terms.
